 Accident Waiver and Release of Liability Form for individuals participating in the Barefoot Wawasee Challenge.

ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM I acknowledge that this Accident Waiver and Release of Liability Form will be used and relied upon by the event holders, sponsors, organizers, beneficiaries, charities and volunteers in any way associated with the Barefoot Wawasee Challenge (hereafter the released persons and entities), and that it will govern my actions and responsibilities at said activity or event. In consideration of the opportunity to participate in this event and benefit designated charities, I hereby for myself, my executors, administrators, heirs, next of kin, successors, and assigns agree and as follows: 

(A) I WAIVE, RELEASE, AND DISCHARGE the released persons and entities from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may occur to me by reason of the event, including my traveling to and from this event. I certify that I am sufficiently physically fit for participation in the Barefoot Wawasee Challenge, that I have not been advised to not participate by a medical professional and that there are no health-related reasons or problems which preclude my participation in the event. I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity or event. 

(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the released persons and entities from any and all liabilities or claims made as a result of any aspect of the event or my participation in this event, whether caused by the negligence of the released persons and entities or otherwise. I acknowledge that this event may carry with it the potential injury, death and property loss. The risks may include, but are not limited to, those caused by water, submersed items, terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, actions of other people including, but not limited to, the released persons and entities, participants, volunteers, spectators, event officials, and event monitors, and/or producers of the event. I expressly assume the risks of participating in the event. In the event that one or more of my minor children participate in the Barefoot Wawasee Challenge with me, I acknowledge and assume the risks identified above with respect to their participation and agree to indemnify the released persons and entities. I further certify that I will remain in their immediate proximity during the event and supervise them so as to avoid injury. 

(C) I understand that at this event or related activities, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the event holders, producers, sponsors, organizers, and assigns. This accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. 

I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
